I. Statement of Claim
- The Defense claims that Mr. White did not premeditate any of his actions and only wanted to cause physical harm as a form of self defence.
- The Defense claims that Mr White was simply driving through Legion Square, was hit by a white 14 charger and turned around to see what caused him to be hit by this car. It was at this point where officers started shooting him.
- The Defense claims that Mr White was simply fearing for his life as he was shot at by officers for simply just being in the area.
- The Defense claims that there was not enough time to premeditate the shootout as they fled from Legion Square to Pillbox.
- The Defense claims that the suspect didn’t know about Jayden Santiago’s warrant beforehand in order to premeditate the activities that occurred at Pillbox Hospital on 03/09/2023.
- The Defense claims that since Steve’s last arrest was for a jewellery store robbery on the 29th of July, the argument of ‘he has done this many times before’ is invalid. (This is one of the reasons J.Dirte gave the Defense when asked why it was premeditated).
- Given that the above statements best match the charge for P.C. 203 “Aggravated Assault and Battery” (“Uses violence to cause physical harm to another person with a weapon”), the Defence claims that rather than charging Mr. White with “Attempted Murder [GE, PP] x7 he should have been charged with “Aggravated Assault and Battery [GE, PP] x7.
