I. Statement of Claim

1. The Defense claims that neither Mr. Lawson, nor Mr. Epps were at the scene of the Jewelry Store Robbery that they are charged with Aiding and Abetting.

1. The Defense claims that neither Mr. Lawson, nor Mr. Epps were aware of what crime had been committed by the suspects they attempted to assist until after they were already involved.

1. Given that the above statements best match the enhancement for P.C. 1101 "Accomplice" ("Any person not present when the crime itself is committed, but has knowledge of the crime before or after the fact, and may assist in its commission"), the Defense claims that rather than charging Mr. Lawson and Mr. Epps with "Armed Robbery of a Jewelry Store (AAA)" they should have been charged with "Armed Robbery of a Jewelry Store (ACC)".

1. Additionally, because Mr. Epps, who is accused of roughly the same crime/involvement as Mr. Lawson, was NOT charged with Kidnapping (AAA), the Defense claims that the same charge should not be charged for Mr. Lawson. Mr. Epps's kidnapping charges were a separate instance whereas Mr. Lawson is being charged with AAA kidnapping at the Jewelry Store robbery.

The DA's Office has discussed with the Defense and would like to agree on a settlement.

The enhancement on Armed Robbery of a Jewelry Store would be changed from Aiding & Abetting to Accessory and the Kidnapping (AAA) Charge against Will Lawson will be dropped as well.

AJ Epps will receive $2750 in restitution for the time served and fine he paid.
Will Lawson will receive $6250 in restitution for the time served and fine he paid.
