I. Statement of Claim
1. The defense claims that the defendant did in fact not get drug tested, resulting in an illegal search per the original incident report which states a drug test was performed, and came back positive resulting in a search and then an arrest.
2. The defense requested the evidence (drug test) and was informed by Atlas East, that there was not a drug test.
3. After subpoenaing for the drug test results, the defense had been informed that the incident report had been changed stating that they did not perform a drug test.
4. It is clear that Atlas East, filed a false report of a crime, and then tampered with the evidence by changing the incident report.
