I. Statement of Claim
The defendant appeals their charges on the grounds that there was insufficient evidence to support the charges and that the arrest lacked probable cause. Kay Jorner was convicted of Felony Evading a Peace Officer (AAA) and Possession of a Class 3 Weapon following a search incident to arrest. Kay Jorner further states that officers were unable to explain the basis for the arrest when asked and believes the subsequent search, and resulting possession charge, were the product of an unlawful arrest.
We respectfully request that the court review the charges, suppress any evidence obtained as a result of the unlawful arrest if appropriate, and dismiss any charges not supported by the evidence.
