I. Statement of Claim
On March 24th, my client robbed a Jewellery Store, taking a dog as a hostage. My client was partaking in negotiations with the police on scene, and eventually the officers decided to breach the Jewellery Store. Whilst breaching, my client was struck 3 times in the chest with bullets, which caused him to sustain injuries and bleed.
After this, my client ran out to the vehicle with his associate and fled. After some vehicle swaps, my client got out of the vehicle after the vehicle flipped and ran from officers. My client discharged his weapon towards officers, however, was met with multiple tazer shots, which disabled him and he was put into cuffs.
My client required medical attention due to the bullets shot at him prior in the Jewellery Store. He asked for medical attention, and Officer George Travis denied him of his right to medical attention. My client was told he would get medical attention, but never ended up getting it. BCFD were called to the cells of MRPD and they advised that my client should be treated in a hospital.
Despite this advice from someone who has received medical training, Officer Eddy Briggs said that he was told to 'not give medical attention' to my client. My client, at the time, still had 3 GSWs to the chest and was in dire need of medical attention, which was not provided by the officers.
When dealing with suspects, Officers are required by law to care for their health. As my client was in custody, Officers were solely responsible for his wellbeing. Despite this, Officers failed to ensure his rights were met, by offering medical attention after being shot multiple times.
II. Relief
Due to the traumatic incidents that occurred, we are seeking the following relief:
- $50,000 for unlawful pain & suffering, alongside negligence on behalf of the Police Department.
- $10,000 for lawyer fees.
- Require all 3 officers directly involved to go through appropriate training to ensure all individuals under their custody and care receive appropriate medical attention when requested/required.
