I. Statement of Claim
We hereby submit this Statement of Claim to outline the circumstances surrounding an incident that occurred on September 23rd, 2023, and to seek redress for the damages suffered by Mr. Snergerberger due to the alleged negligence of the Defendant, CO-302 Mike West, and others, in the placement of spike strips on the sidewalk outside of the Bazaar, located at Alta / Elgin Avenue

On September 23rd, 2023, at approximately 9PM EST, Mr. Snergerberger, who is bound to a wheelchair, was navigating the sidewalk outside of the Bazaar.

The Defendants, CO-302 Mike West, CO-307 Xander Killbourne, CO-333 James Goff Jr., and LT-129 Quintin Johnson, were on the scene as part of a parking patrol and had allegedly placed spike strips on the sidewalk with the intent to prevent parking violations. It is crucial to emphasize that spike strips are intended for use in situations involving high-speed vehicle pursuits to safely disable vehicles and are not intended to be placed on public sidewalks.

Due to the improper placement of the spike strips, Mr. Snergerberger's wheelchair came into contact with the sharp spikes, causing significant damage to both his person and his wheelchair. This incident resulted in physical injuries, emotional distress, and substantial financial losses for Mr. Snergerberger.

1. The Plaintiff asserts that the Defendants, CO-302 Mike West, CO-307 Xander Killbourne, CO-333 James Goff Jr., and LT-129 Quintin Johnson, were negligent in placing spike strips on the sidewalk outside of the Bazaar, which directly led to the injuries and damages suffered by Mr. Snergerberger.​

2. The Plaintiff contends that the use of spike strips in such a manner is inappropriate, dangerous, and not in accordance with their intended purpose, as it poses a clear and foreseeable risk to pedestrians like Mr. Snergerberger.​

3. The Plaintiff further alleges that the Defendants, CO-302 Mike West, CO-307 Xander Killbourne, CO-333 James Goff Jr., and LT-129 Quintin Johnson, failed in their duty to ensure the safety of pedestrians while conducting parking patrol duties.​

II. Relief
The Plaintiff seeks the following relief in this matter:

a. Compensation for the damages and repair costs related to Mr. Snergerberger's wheelchair.
$1,000

b. Damages for pain and suffering, emotional distress, and loss of enjoyment of life experienced by Mr. Snergerberger. $5,000

c. Legal costs and attorney's fees incurred by the Plaintiff in pursuing this claim.
$10,000

d. Any further relief that the Court deems just and equitable.
